data-fusion-google-variant=\"500\">compenser la disparit\u00e9 que la rupture du mariage cr\u00e9e<\/span> dans les conditions de vie respectives des \u00e9poux.<\/p>\n<p>Elle a un caract\u00e8re forfaitaire et prend la forme d\u2019un versement en <span style=\"font-family: 'Work Sans'; font-weight: 500;\" data-fusion-font=\"true\" data-fusion-google-font=\"Work Sans\" data-fusion-google-variant=\"500\">capital<\/span> ou \u00e0 titre exceptionnel d\u2019une <span style=\"font-family: 'Work Sans'; font-weight: 500;\" data-fusion-font=\"true\" data-fusion-google-font=\"Work Sans\" data-fusion-google-variant=\"500\">rente viag\u00e8re<\/span>.<\/p>\n<p>Elle peut \u00e9galement \u00eatre mixte.<\/p>\n<p>Elle peut \u00eatre attribu\u00e9e par le jugement de divorce \u00e0 l\u2019un des \u00e9poux quelque soit la cause du divorce ou la r\u00e9partition des torts.<\/p>\n<p>N\u00e9anmoins, le juge peut la refuser lorsque le divorce a \u00e9t\u00e9 prononc\u00e9 aux torts exclusifs d\u2019un \u00e9poux.<\/p>\n<p>Les parties peuvent librement s\u2019accorder sur le montant, les modalit\u00e9s et la forme de la prestation compensatoire.<\/p>\n<p>Dans le cadre d\u2019un divorce par consentement mutuel, elle est pr\u00e9vue par la convention des \u00e9poux.<\/p>\n<p>Dans les autres cas de divorce, elle peut r\u00e9sulter d\u2019un accord qui sera alors homologu\u00e9 par le juge s\u2019il respecte les int\u00e9r\u00eats des parties et des enfants.<\/p>\n<p>En cas de d\u00e9saccord, il appartiendra au juge de la class=\"fusion-li-item-content\" style=\"margin-left:33.6px;\">\n<p>Les sacrifices faits par l\u2019un des \u00e9poux pendant la vie commune pour favoriser la carri\u00e8re professionnelle de l\u2019autre \u00e9poux ou pour l\u2019\u00e9ducation des enfants<\/p>\n<\/div><\/li><\/ul><div class=\"fusion-separator fusion-full-width-sep\" style=\"align-self: center;margin-left: auto;margin-right: auto;margin-top:15px;margin-bottom:15px;width:100%;\"><\/div><div class=\"fusion-text fusion-text-3\"><p>En cas de changement important dans la situation de l\u2019un des \u00e9poux (ch\u00f4mage, remariage du b\u00e9n\u00e9ficiaire,\u2026) la prestation compensatoire peut \u00eatre r\u00e9vis\u00e9e, suspendue ou supprim\u00e9e.<\/p>\n<p>La r\u00e9vision n\u2019est pas
